There has been an explicit shift away from universalist principles in welfare and a more explicit focus on means testing and the management of incentives to work. Today, social citizenship as ascribed rights of access to benefits and services is denigrated as encouraging a ‘something for nothing society’ and is being replaced by a conception of citizenship more in keeping with the consumer society; that is, citizenship that is achieved by work and the acceptance of the obligations of civic activeness.

The understanding of the broader economic and global forces shaping working-class community life and child poverty may be part of the government’s broader policy agenda, but it is not being allowed to get in the way of the more populist and short-term political gains to be won through being ‘tough on crime and those labelled antisocial’. It is clear that being tough on the causes of crime and incivility raised too many politically and economically contentious issues to be allowed a central place in the policy agenda for the first post-Blair general election, and there is little to indicate that either Gordon Brown or, indeed, David Cameron will change the direction of criminal justice policy in the medium to long term.

While a great deal of the public debate about behaviour and incivility concentrates on the use of restrictive powers such as ASBOs, focusing on the legal principles underpinning their application, there are deeper sociological issues attaching to the exercise of social control in the context of incivility that must be addressed. The debate tends to revolve around whether or not natural justice is violated by the use of civil law standards of evidence, which require only that facts are established by the balance of probabilities, and can allow the admission of hearsay evidence, rather than the criminal law standard, which requires that facts be established beyond reasonable doubt, and allows confrontation of witnesses.
